Acceptable use policy
What you may and may not do when using Zobi.
Scope
This acceptable use policy (the “AUP”) applies to everyone who uses Zobi and to all content sent through the service. Zobi is operated by Zobi OÜ (an Estonian private limited company, osaühing), and is a conversational-commerce sales tool for Shopify stores. It sends AI-written messages to a merchant’s customers over iMessage, with SMS and RCS as fallback, to recover checkouts and drive repeat purchases. The merchant is the sender and the controller of those messages. Zobi provides the platform.
This AUP is incorporated into, and forms part of, the terms of service by reference. By using Zobi you agree to this AUP and to the terms of service. If you do not agree, you must not use the service. Capitalised terms not defined here have the meaning given in the terms of service. We may update this AUP from time to time as described under “Changes” below; continued use after a change means you accept the updated version.
Prohibited activities
You must not use Zobi, or allow or enable anyone else to use it, for any of the following:
- Illegal use of any kind. Anything that breaks applicable law or regulation, or that helps another person break the law, and the sale or promotion of illegal goods or services.
- Messaging without consent. Sending any message without valid, documented consent from the recipient, or after a recipient has opted out.
- Spam and unsolicited messaging. Sending spam, bulk unsolicited messages, or any messaging that violates anti-spam law or carrier rules. All messaging must follow our messaging policy.
- Phishing, fraud, and deceptive offers. Phishing, fraud, scams, deceptive or misleading offers, fake promotions, or any attempt to obtain money or data by deception.
- Harassment, threats, and hateful content. Sending content that is harassing, abusive, threatening, defamatory, obscene, or that promotes hatred or violence against any person or group.
- Impersonation. Impersonating any person or organisation, or otherwise misrepresenting who you are or your affiliation with anyone.
- Infringing the rights of others. Infringing intellectual property, publicity, or privacy rights, including sending content you do not have the right to send.
- Malware and harmful code. Distributing malware, viruses, ransomware, or any other harmful or disruptive code.
- Unlawfully obtained or scraped numbers. Uploading or messaging phone numbers or contact lists obtained unlawfully, scraped, purchased without consent, or otherwise not collected by you with a valid lawful basis.
- Attacks on the service. Attempting to breach security, probe, scan, scrape, reverse engineer, decompile, disassemble, overload, or circumvent rate limits, quotas, authentication, or other usage or security controls.
- Unauthorized resale. Reselling, sublicensing, renting, or providing the service to third parties without our written permission.
- Building a competing product. Using the service, or any data, output, or know-how derived from it, to build, train, or assist a product or service that competes with Zobi.
- Interfering with others. Interfering with or disrupting other users, the service, or its underlying infrastructure.
Prohibited and restricted content and industries
Some content and industries are not allowed on Zobi, and some need our prior approval. You must not use the service for any of the following without our written approval, and in some cases we will not permit them at all:
- SHAFT content. Sex, hate, alcohol, firearms, and tobacco.
- Illegal drugs and controlled substances.
- Weapons and firearms.
- Adult or sexually explicit content.
- Gambling, betting, and lotteries where restricted by law or carriers.
- High-cost short-term and payday lending.
- Debt collection and debt relief services where restricted by carriers.
- Other regulated or high-risk categories that carriers or messaging channels restrict or prohibit. Some of these may require prior approval, and some are not permitted at all.
Carrier and messaging-channel rules also apply on top of this policy. Where those rules are stricter, the stricter rule controls. See the messaging policy for detail.
Responsibility for your account
You are responsible for everyone who acts under your account, including your staff, contractors, agents, and any third party you give access to. Their acts and omissions are treated as yours. If you allow any third party to use the service through your account, you must impose restrictions on them that are at least as protective as this AUP, and you remain fully responsible for their compliance.
Data you may process
You may only put data into Zobi that you are lawfully entitled to use. Do not upload special-category or other highly sensitive personal data beyond what the service is designed to handle. You are responsible for having a valid lawful basis for the data you process through the service, including the consent and contact records behind it.
How we handle personal data on your behalf is set out in the data processing agreement and the privacy policy.
Use of AI features
Zobi writes message content using AI. You must not use generated content for any unlawful, deceptive, or otherwise prohibited purpose. AI output can be wrong or inappropriate, so you are responsible for reviewing and approving what gets sent under your brand. You remain responsible for every message sent from your account, whether written by AI, by you, or by anyone acting on your behalf.
Enforcement
We may, but are not obliged to, monitor use of the service and investigate any suspected violation of this AUP. We have no obligation to monitor content or activity, but we reserve the right to do so. We are the sole judge of whether a violation has occurred.
Where we determine, at our sole discretion, that a violation has occurred or is reasonably suspected, we may, with or without notice and without liability:
- Throttle, suspend, or terminate your access to the service, in whole or in part.
- Remove, disable, or refuse to transmit any content.
- Disable messaging for your account or a specific brand.
- Refuse to provide the service to you in future.
- Report the activity to, and share relevant information with, carriers, messaging and infrastructure providers, Shopify, Apple, payment providers, and law enforcement or other authorities.
We may take any of these actions at our sole discretion. To the maximum extent permitted by applicable law, we are not liable for any action we take in good faith to enforce this AUP, including throttling, suspension, termination, removal or refusal of content, or reporting to third parties. Nothing in this AUP excludes or limits liability that cannot be excluded or limited under the laws of the Republic of Estonia or under mandatory provisions of European Union law, including liability for intent (tahtlus) or gross negligence. These rights are in addition to any rights we have under the terms of service.
Changes to this policy
We may update this AUP from time to time. When we do, we will revise the date shown at the top of this page, and material changes take effect when posted. Continued use of the service after a change means you accept the updated AUP. This AUP is governed by the laws of the Republic of Estonia, and is incorporated into the terms of service by reference; if there is a conflict, the terms of service control.
